These Payment Terms (“Terms”) govern all purchases of digital credits and access to paid functionalities made through mtgmaster.ai (the “Service”), operated by Marc Dalmau Ballester, a self-employed professional (“Autónomo”) established in Spain.
By purchasing or using credits, you accept these Terms in full.

1. Nature of the Product: Digital Credits

The Service offers digital credits (“Credits”) that can be used to unlock premium features such as AI tools, advanced analytics, or enhanced utilities.

Credits have no real-world monetary value.
Credits are non-transferable.
Credits do not grant ownership over software or intellectual property.
Credits are considered digital content / digital services under EU law.

Delivery is automatic upon payment confirmation.

2. Payment Processing

Payments are processed exclusively through Stripe or equivalent PCI-DSS–compliant providers.

Stripe handles:

Card processing
Fraud detection
Payment confirmations
Security of payment data

We do not store or access your full payment card details.

3. Pricing and Taxes

Prices for Credits:

Are displayed in [CURRENCY]
May include or exclude taxes depending on location
May change over time (changes apply only to future purchases)

Where required:

VAT is charged according to EU rules for digital services
Invoices include Owner’s name, NIF, and legal details

4. Delivery of Credits

Credits are delivered:

Instantly, once Stripe confirms successful payment
Automatically added to the user’s account

If delivery does not occur within 15 minutes, contact [EMAIL] for assistance.

5. Refund Policy (EU & International)

This section forms part of the Payment Terms and applies to all users worldwide, unless their local laws provide stronger rights—in which case, those rights prevail.

5.1 EU Right of Withdrawal (Digital Services)

Under EU Directive 2011/83 on Consumer Rights, digital content that is delivered instantly and consumed immediately is exempt from the right of withdrawal if:

The consumer explicitly agrees that the service begins immediately;
The consumer acknowledges that they lose their withdrawal right once execution begins.

By purchasing credits, you acknowledge and agree that:

Delivery occurs instantly
Execution begins immediately
You waive your right of withdrawal
No refund will be provided after credits are delivered

This is required by EU law and displayed clearly during checkout.

5.2 Refund Situations Where Refund Is Possible

Refunds may be granted only in the following exceptional cases:

(a) Duplicate purchases

If you accidentally purchased Credits more than once.

(b) Technical failure

If Credits are not delivered because of a verifiable technical error.

(c) Fraud or unauthorized payment

If your payment method was used without your authorization (proof required).

(d) Legal obligation

If any consumer protection law applicable to your jurisdiction requires us to refund.

5.3 Non-Refundable Situations

Refunds will not be issued for:

Credits already delivered and/or consumed
Change of mind
Unused Credits (unless legally required)
Dissatisfaction with AI or digital output quality
Account termination due to Terms violations
“I didn’t mean to spend the credits” once features were executed

5.4 International Users (Non-EU)

Unless a user’s local laws grant stronger mandatory rights, the same refund rules apply globally:

Instant digital delivery = no withdrawal / no refund
Exceptions listed above still apply

This approach ensures fairness and consistency across all jurisdictions.

6. Chargebacks

If a chargeback is initiated:

The affected account may be temporarily suspended
Credits earned from the transaction will be removed
We may request verification documents
Unjustified chargebacks may result in permanent account closure

7. Fraud, Abuse, and Misuse

We reserve the right to:

Freeze account balances
Reverse credit transactions
Suspend accounts
Ban users

…if fraudulent or abusive behavior is detected.

Examples include:

Using stolen payment methods
Exploiting bugs to gain Credits
Attempting to manipulate pricing or credit consumption
Sharing/buying/selling accounts

8. Credit Expiration

By default:

Credits do not expire
If the Service is discontinued, an attempt will be made to notify users

Credits remain valid as long as the Service is operational.

9. Account Binding

Credits belong to the specific account that purchased them and cannot be:

Transferred
Gifted
Traded
Cashed out

If access to an account is lost, identity verification may be required to restore it.

10. Changes to Credit Pricing or Consumption Rates

We may update:

Credit package prices
Credit-based consumption rates
Paid feature structures

These updates do not affect credits already purchased but may affect future usage costs.

We will give reasonable notice of major changes when possible.

11. Currency Conversion and Fees

If your bank account uses a different currency:

Stripe or your bank may apply conversion fees
Exchange rates are determined by your payment provider
We do not charge or control these fees

13. Governing Law & Jurisdiction

These Payment Terms—including the Refund Policy—are governed by the laws of:

Applicable European Union consumer and digital service regulations

For users outside the EU, local mandatory consumer protections may also apply.

Unless consumer legislation mandates a different jurisdiction, disputes will be submitted to the courts of the Owner’s domicile in Spain.

By completing a purchase, you acknowledge that you have read and accepted these Payment Terms, including the Refund Policy.
